Terms of Service

Effective October 22, 2026

The service

Fluid Clinical provides a software platform for clinical trial data collection and management. By creating an organization or using the platform you agree to these terms on behalf of the organization you represent. Enterprise agreements signed with Fluid Clinical take precedence over these terms where they differ.

Accounts and trials

Self-serve signups start a 14-day free trial with no payment details required. You are responsible for the accuracy of your account information, the confidentiality of your credentials, and all activity under your organization's accounts. Accounts must belong to individual named users; shared credentials defeat the signature and audit controls the platform exists to provide and are prohibited.

Your data

Study data entered into the platform belongs to the customer organization and its sponsors, not to Fluid Clinical. We process it only to provide the service, under the applicable agreements. Export in human-readable and machine-readable formats is available at all times, including audit trails.

Regulatory responsibilities

The platform implements technical controls designed to satisfy 21 CFR Part 11, HIPAA, and ICH GCP E6(R3) requirements for electronic records and signatures. Regulatory compliance of a study also depends on customer procedures, training, and oversight, as described in the shared-responsibility matrix we publish. Customers remain the regulated parties for the studies they conduct, including required certifications to regulators regarding electronic signature use.

Acceptable use

You agree not to attempt to defeat access controls, probe other tenants' data, upload unlawful content, or use the platform for purposes other than conducting and managing clinical research. We may suspend access that threatens the security or integrity of the service, and will notify affected customers promptly.

Availability and changes

We operate the service with commercially reasonable care, publish maintenance windows in advance where practical, and preserve regulated records and their audit trails across upgrades. During early access, features may change with notice; regulated record invariants do not.

Liability

To the maximum extent permitted by law, Fluid Clinical's aggregate liability under these terms is limited to the fees paid for the service in the twelve months preceding the claim, and neither party is liable for indirect or consequential damages. Nothing in these terms limits liability that cannot lawfully be limited.
